Section 6001.04.02.01.04.01 states “When the volume of brine/water exceeds 325,000 litres per year, the Contractor shall be compensated for the disposal costs of the material at invoice cost. Compensation for all labour, Equipment and Material to removal and transportation shall be included under the Lump Sum Price”. Being responsible for any labour and equipment costs without a limit to the annual quantity creates significant risk to the contractor. Will the Ministry consider apply risk sharing to all costs related to disposal after the 325,000 litres?

The Ministry will not be applying risk sharing to all costs related to disposal after the 325,000 litres. Historical volumes of brine/water removed from Boundary Patrol containment area has been provided in Addendum 3.
