Response to BE-2014-2002-62: Using Fence Line as Existing Right-of-Way Boundary

Part a) With reference to the Ministry’s response to BE-2014-2002-062: Section 2.4.3 of the RFP states “The Design-Builder is responsible for designing and constructing the Project to fit within the current property limits.” Given that the Ministry’s response instructs the Design-Builder keep all the grading / retaining walls within the existing fence lines instead of the property line, and considering that keeping the grading within the existing fence line results in hundreds of meters of permanent retaining wall, we request that the MTO issue an addendum to cover this change in RFP requirement. Part b) OPSD 200.010 requires that the crest and toe of a slope be 1.5m from the right-of-way limit. Since this limit has not been provided is the Design-Builder to assume that the crest and toe of slope need to be 1.5m from the fence line? Or can the Design-Builder construct all walls/grading within the limit of the fence line and still comply, as the response to BE-2014-2002-062 suggests?
