Document 2 “Preliminary Design and Class Environmental Assessment Study – Preliminary Design Report (Draft)” dated September 2014, Page 7-1, Section 7.1 states that no additional property is required to implement the Recommended Design. Assessment of preliminary grading requirements at 16 Mile Creek and the CPR crossing indicate construction of standard MTO granular and fill side slopes will necessitate the requirement for additional property or implementation of retaining systems/ engineered slopes (steeper than 2:1). If TLIs are obtained during construction, it is assumed that all temporary grading outside the existing ROW would have to be reinstated to the extent required to maintain drainage ditches within the ROW (i.e. portions of the detour would have to be removed). Please confirm MTO is not seeking permanent or temporary limited interests to facilitate construction of the recommended design?

MTO is not seeking permanent or temporary limited interests to facilitate construction of the Recommended Design. Per Section 2.4.3 of the RFP, the Design-Builder is responsible for designing and constructing the Project to fit within the current property limits.
